1Information We Collect

  • Contact & inquiry data: Name, email address, phone number, business name, and website URL you provide through our website forms, lead capture modal, advertising or partner lead forms (e.g., Google or Meta), or direct email.
  • Usage data: IP address, browser type, device type, pages visited, time on site, and referring URLs collected automatically via cookies and analytics tools.
  • Communications: Content of messages, feedback, and correspondence you send us through any channel.
  • Payment data: Billing information processed securely through third-party payment processors. We do not store full credit card numbers on our servers.
  • Cookies & tracking technologies: Session cookies, persistent cookies, and similar technologies used to operate and improve our website and communications.

2How We Use Your Information

  • To respond to inquiries, deliver the services you request, and manage our business relationship with you — including one-to-one phone, email, and text messages about your request or project (not broadcast promotional SMS).

3Legal Basis for Processing (GDPR)

For users in the European Economic Area, our legal bases for processing personal data are: (a) Contract — processing necessary to deliver services you have requested; (b) Legitimate interests — operating and improving our business, provided those interests are not overridden by your rights; (c) Consent — where you have explicitly provided consent, such as subscribing to marketing communications; and (d) Legal obligation — where processing is required by applicable law.

4Cookies & Analytics

  • Essential cookies: Required for basic website functionality. Cannot be disabled.
  • Analytics cookies: We use tools such as Google Analytics to understand how visitors interact with our site. These may set persistent cookies. You may opt out at analytics.google.com/analytics/optout.

  • Advertising / Microsoft UET: We use the Microsoft Universal Event Tracking (UET) tag to measure ad performance and lead conversions from Microsoft Advertising. UET may set first-party cookies and collect page views and custom events (such as form submissions). 5SMS / Text Messaging

  • If you provide a U.S. mobile number and affirmatively opt in by checking the optional SMS consent box on our forms (the box is not pre-selected and is not required to submit a form or receive our services), you agree that Brand Bongo may send you text messages about your inquiry and related service communications — for example, to reach you about your request, schedule a call, or discuss your project and our offer.
  • Messages are one-to-one (not mass marketing broadcasts). Some messages may be sent using automated or templated workflows in connection with your inquiry.
  • Message frequency: Frequency varies depending on your inquiry; typically a few messages per inquiry.
  • Text messages are delivered through Twilio. Message and data rates may apply. U.S. numbers only.
  • You can opt out at any time by replying STOP. For help, reply HELP or contact us at legal@brandbongo.com.
  • We do not sell or share your mobile phone number with third parties for their own marketing purposes. We do not send SMS based on partial or abandoned form submissions that did not include this consent. You may complete any form or request our services without opting in to SMS.

6Advertising & Partner Lead Forms

  • We may collect inquiry information through advertising lead forms hosted by platforms such as Google or Meta (e.g., name, email, phone number, and other fields shown on the form).
  • Those platforms process submissions according to their own terms and privacy policies. When you submit a hosted lead form, the platform may share that data with Brand Bongo so we can respond to your inquiry.
  • We use lead data to contact you about your request, deliver services, and operate our business. We may store leads in our CRM and communicate via email, phone, or SMS as described in this policy.
  • For SMS from advertising lead flows, you must receive equivalent SMS consent disclosure before we text you, consistent with applicable law and carrier requirements.

7Sharing & Disclosure of Information

  • Service providers: We share data with trusted vendors (hosting, analytics, email delivery, SMS delivery via Twilio, payment processing, CRM platforms such as Kommo) who are contractually bound to protect your data and use it only as directed. Lead form submissions are stored in our CRM system for follow-up.
  • Business transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred to the successor entity. We will notify you prior to any such transfer.
  • Legal requirements: We may disclose information where required by law, court order, or government authority, or where necessary to protect our legal rights.
  • We do not sell your personal information to third parties for their own marketing purposes, including mobile phone numbers collected for SMS.

8Data Retention

We retain personal data for as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required by law. Client project data is retained for a minimum of 5 years for business and legal recordkeeping. You may request deletion of your personal data subject to our legal and contractual obligations by contacting legal@brandbongo.com.

9Your Rights

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate or incomplete data.
  • Deletion: Request deletion of your personal data, subject to legal and contractual obligations.
  • Portability: Request your data in a structured, machine-readable format.
  • Objection / Restriction: Object to or request restriction of certain processing activities.
  • Withdraw consent: Where processing is based on consent, withdraw it at any time without affecting the lawfulness of prior processing.
  • California residents (CCPA): You have the right to know what personal information is collected, request deletion, and opt out of the sale of personal information. Brand Bongo does not sell personal information or mobile numbers for SMS.

10Data Security

We implement industry-standard technical and organizational security measures including SSL/TLS encryption in transit, access controls, and secure hosting infrastructure to protect your personal data. No method of transmission over the internet is 100% secure. While we strive to protect your data, we cannot guarantee absolute security and encourage you to contact us immediately if you suspect unauthorized access.

11Third-Party Links

Our website may contain links to third-party websites. This Privacy Policy applies only to our site. We are not responsible for the privacy practices or content of linked third-party sites and encourage you to review their privacy policies independently.

12Children's Privacy

Our services are directed to businesses and individuals aged 18 and older. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us immediately at legal@brandbongo.com and we will promptly delete it.

We may update this Privacy Policy periodically to reflect changes in our practices or applicable law. When we do, we will revise the "Last updated" date above.
